Terms and conditions

1. Purpose

These general terms and conditions (GTC) govern the relationship between DR Immo Caraïbes and any client (seller or buyer) for real estate transaction services carried out in Guadeloupe.

2. Services

DR Immo Caraïbes acts as a real estate agent to connect sellers and buyers of real estate properties. Our services include:

  • Property valuation and marketing
  • Listing distribution and promotion
  • Organising viewings
  • Negotiation and drafting of sale agreements
  • Support through to the notarial deed

3. Fees

Our fees are payable by the seller, unless otherwise expressly agreed in writing. The amount of fees is specified in the sales mandate and/or in the property listing. Fees are due upon signing of the notarial deed or sale agreement, in accordance with the mandate terms.

4. Sales mandate

The sales mandate is concluded for a fixed term specified in the contract. It may be renewed by tacit renewal under the conditions provided by the Hoguet law. The seller agrees to inform the agency of any sale made outside the mandate.

5. Seller's obligations

The seller agrees to:

  • Provide all documents and information necessary for the sale
  • Inform the agency of any event likely to affect the sale
  • Not sell the property independently during the mandate period (except for non-exclusive mandates)
  • Pay the fees upon completion of the transaction

6. Buyer's obligations

The buyer agrees to:

  • Verify their borrowing capacity before making any purchase offer
  • Comply with withdrawal periods and conditions precedent
  • Sign the notarial deed on the agreed dates

7. Confidentiality

The parties agree to keep confidential all information exchanged in connection with the transaction. DR Immo Caraïbes processes personal data in accordance with its privacy policy.

8. Liability

DR Immo Caraïbes implements all necessary means to ensure the quality of its services. Its liability can only be engaged in the event of proven fault and within the limit of direct damage.

9. Applicable law and disputes

These GTC are governed by French law. In the event of a dispute, the parties will endeavour to find an amicable solution. Failing that, the competent courts will be those in the jurisdiction of DR Immo Caraïbes' registered office.
